JJ Motorsports ("we," "us," "our," or "Company") operates the website jj-motorsports.com (the "Site" or "Service"), an e-commerce platform specializing in the direct sale of aftermarket motorsports parts and accessories. These Terms of Service ("Terms") govern your access to and use of the Site, including any content, functionality, products, and services offered on or through the Site.
By accessing or using the Site, placing an order, creating an account, or otherwise engaging with our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site. These Terms apply to all visitors, users, customers, and others who access or use the Service.
You represent that you are at least 18 years old or the age of majority in your jurisdiction and have the legal capacity to enter into these Terms. If you are accessing the Site on behalf of a company or entity, you represent that you have the authority to bind that entity to these Terms.

1. Interpretation and Definitions
Interpretation
Words with initial capitalization have meanings defined below. These definitions apply whether singular or plural.
Definitions
- Affiliate: An entity controlling, controlled by, or under common control with a party, where "control" means ownership of 50% or more of shares or voting rights.
- Account: A unique account created for you to access parts of our Service.

- Content: Text, images, or other information posted, uploaded, or made available by you.
- Device: Any device accessing the Service, such as a computer or mobile phone.
- Feedback: Suggestions or innovations you provide about our Service.
- Products: Aftermarket motorsports parts and accessories sold on the Site.

2. User Accounts and Registration
To access certain features (e.g., placing orders, tracking shipments, or saving preferences), you may need to create an Account. You must provide accurate, complete, and current information during registration and keep it updated. Failure to do so may result in Account suspension or termination.
You are responsible for maintaining the confidentiality of your Account credentials and for all activities under your Account. Notify us immediately of any unauthorized use or security breach. We reserve the right to refuse registration or terminate Accounts at our discretion.
You may not use a username that is offensive, infringing, or misleading. We may remove or reclaim usernames at our sole discretion.
3. Orders and Purchases
All orders are subject to acceptance and availability. We reserve the right to cancel or refuse orders for any reason, including pricing errors, stock issues, or suspected fraud. If we cancel an order after payment, we will refund you promptly.
Product descriptions, images, and specifications are for illustrative purposes and may contain inaccuracies. We do not guarantee exact matches. Prices are in USD, exclude taxes and shipping, and may change without notice.
By placing an order, you authorize us to charge your payment method for the total amount, including taxes and shipping. We accept payments via Authorize.net, PayPal, Google Pay, Venmo, and Apple Pay, processed through secure third-party providers. We do not store full payment details.
Orders may be subject to verification, and we may request additional information to prevent fraud.
4. Shipping and Delivery
We ship Products via third-party carriers (e.g., USPS, UPS). Shipping costs and estimated delivery times are provided at checkout but are not guaranteed. Delays may occur due to weather, customs, or carrier issues—we are not liable for such delays.
You are responsible for providing accurate shipping addresses. If a package is returned due to an incorrect address, you may incur additional fees for reshipping. Title and risk of loss pass to you upon handover to the carrier.
We may restrict shipping to certain locations or add fees for oversized, heavy, or hazardous items (e.g., race fuel or large parts). International shipments may incur customs duties, which are your responsibility.
5. Returns, Refunds, and Exchanges
Our return policy is detailed on the Site and incorporated herein. Generally, returns are accepted within 30 days for unused, unopened Products in original packaging, subject to inspection. Custom or special-order items (e.g., modified parts) are non-returnable.
Refunds exclude shipping costs and may include a restocking fee (up to 20% for motorsports parts). We process refunds to the original payment method within 7-10 business days after approval.
Damaged or defective Products must be reported within 7 days of receipt with photos. We may replace, repair, or refund at our discretion. No returns for buyer's remorse on safety-critical parts (e.g., brakes, helmets).
6. Product Warranties and Disclaimers
Products are sold "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Manufacturer warranties, if any, apply directly—contact the manufacturer for claims.
We disclaim liability for Product compatibility, performance, or safety. Motorsports parts may be for off-road or racing use only and not street-legal. You are responsible for verifying fitment, compliance with laws (e.g., emissions, safety standards), and professional installation.
We are not liable for damages, injuries, or losses from Product use, misuse, or failure. Use at your own risk.
7. Intellectual Property
The Site, including text, graphics, logos, images, and software, is owned by us or our licensors and protected by US and international copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written consent.
Product images and descriptions are for reference; unauthorized use is prohibited.
8. User-Generated Content
If the Site allows reviews, comments, or uploads ("Content"), you grant us a perpetual, irrevocable, royalty-free license to use, modify, and distribute such Content. You represent that your Content is lawful, non-infringing, and accurate.
Prohibited Content includes: spam, offensive material, viruses, or anything violating laws or rights. We may remove Content at our discretion but are not obligated to monitor it.
9. Copyright Infringement (DMCA Policy)
We respect intellectual property. To report infringement, send a DMCA notice to support@jj-motorsports.com including: your signature, description of the work, location of infringement, your contact info, and a good-faith statement.
We may terminate repeat infringers' Accounts.
10. Limitation of Liability
To the fullest extent permitted by law, we and our Affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the Site or Products, even if advised of the possibility.
Our total liability shall not exceed the amount you paid for the Product in question. Some jurisdictions limit such disclaimers, so they may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, or damages arising from your breach of these Terms, misuse of the Site, or violation of laws.
12. Dispute Resolution
Any disputes arising from these Terms or the Site shall be resolved through binding arbitration under AAA rules in Muskegon, Michigan, except for small claims or injunctive relief. You waive class actions and jury trials.
Governing law: Michigan, without conflict of laws principles.
13. Changes to These Terms
We may update these Terms at any time. Changes are effective upon posting, with notice via email or Site alert for material changes. Continued use constitutes acceptance.
14. Miscellaneous
If any provision is unenforceable, the rest remain in effect. No waiver implies future waivers. These Terms constitute the entire agreement. Force majeure excuses delays beyond our control.
